Q What exactly is a mortgage?

A. When the mortgage deed you have signed is completed the obligation to repay the money you have borrowed is secured upon your property. If you default the lender has a right to require your property to be sold and to be repaid out of the proceeds of sale. Whilst you will be registered as the owner of the property, the lender will be registered as the owner of the charge created by the mortgage, and the lender's name will appear on the Charges Register at the Land Registry.

The mortgage deed itself is a Loan Agreement between you and the mortgage lender. It incorporates a number of conditions and covenants that you must observe - the main one is to make payments of interest and capital too (in repayment mortgages) on the dates specified . There are many others covenants e.g. for you not to sub-let without their consent and covenants relating to insurance and maintenance.
